Maintenance fees in more than half of Hanoi apartments not handed over yet

The Ministry of Construction has recently announced results of State management inspection on management and use of apartment buildings in Hanoi on its portal. In Ho Chi Minh City, this agency also set up an inspection team to implement the same tasks.

According to the results, maintenance fees in more than half of Hanoi’s apartments have not been handed over to their management boards. Specifically, there are 254 out of 492 commercial apartments, accounting for 52%, and 33 out of 82 resettlement apartments, making up 40%. Notably, thirty-nine commercial apartments have experienced disputes related to maintenance fees.

Last year, Hanoi People's Committee asked 19 property developers to hand over maintenance budget to management boards of apartment buildings. Two developers, Vinaconex 3 and Song Da Thang Long, even received 2 enforcement decisions. In addition, Hanoi People's Committee also publicly disclosed the list of 13 developers violating regulations on management and use of apartments in the city.

Previously, in the questioning session at the National Assembly, delegates raised questions about disputes at apartment buildings. Minister Pham Hong Ha said the inspection results showed there have been no cases of abuse of the maintenance budget of the apartment buildings. Specifically, at 92 apartment projects inspected, construction inspectors imposed administrative fines of VND 1.3 billion in total. Eleven developers were required to take remedial measures due to late handover. Mr. Ha confirmed that there has been no case of abuse of apartment maintenance budget transferred to the investigation agency.

However, in the opinion of the National Assembly deputies, the developers’ act of appropriating the maintenance budget constitutes a crime. The fact that no cases were detected could be due to the poor capacity of the Ministry of Construction or inspectors did not fulfill their responsibilities.
