The regulation defines principles, responsibilities, competence and coordination mechanisms between state management agencies and related individuals dealing with violations on construction order, management and supervision in the city.
One of the remarkable contents of the document is stipulated in Article 14, which regulates the responsibility of other related agencies. Accordingly, authorized people who sign power and water supply contracts are responsible for temporarily stopping the contracts for works violating construction order regulations when having received documents by Chairman of the People’s Committee at commune/district levels or the Construction Department. Additionally, Article 13 states that the municipal Police has the responsibility to suspend the acceptance of fire prevention and control for violated construction work based on documents issued by Chairman of the People’s Committee at district level or the Construction Department.
Through the newly-issued document, Da Nang city also confirmed the responsibilities of hosting and coordinating agencies in managing, checking and dealing with violations of construction order in the city. On this basis, it will help create a consensus between the Construction Department, the People’s Committee at district and commune level and related individuals in the management, supervision and dealing with the violations
Types of construction works included in the management of construction order are: individual houses, construction works that require construction evaluation in case of exemption of construction permits, construction works requiring the making of economic/technical reports or construction investment projects.
Over the past years, there have been many illegal construction works and those that do not comply with their licenses in Da Nang city. For example, 150sq.m construction works were built without licenses at the Bach Dang Hotel Complex (No.50 Bach Dang, Hai Chau 1 ward, Hai Chau district, Da Nang). The Seven Sea Hotel project (Vo Nguyen Giap, Son Tra district, invested by Ly Bang Service and Investment Limited Company) was licensed to build one basement and 18 floors, but the investor added one more floor (making it 19 floors) and put it into operation by the end of 2017. The Eden hotel project invested by Minh Thuy Limited Company was licensed to build one basement and 22 floors with 96 rooms. However, it raised the number of rooms to 226 without permission. The Muong Thanh hotel and Son Tra luxury department complex changed the function of floors without following the license as well.
According to the municipal Department of Construction, the regulation detailing responsibility of each authorized level aims to strengthen responsibility in the management of construction order, mainly among People’s Committees at district and commune/ward levels. It seeks to avoid blaming the person responsible in detecting wrongful and illegal construction works as well as the leading person in order management in the city.
